Gag Clause Prohibition: Navigating the Compliance Attestation Update
Under the Consolidated Appropriations Act of 2021 (CAA), group health plans and health insurance issuers are prohibited from entering into agreements that restrict certain information from being shared like cost and quality data. This is known as the gag clause prohibition. Employers and plan sponsors are now required to make a Gag Clause Prohibition Compliance Attestation (GCPCA) annually to confirm their vendors' compliance with the prohibition. The first attestations are due in December 2023.
